Divorce in California is a matter of simple phrase known as irreconcilable differences. What does that mean? It means that if you do not see the present situation changing between you and your spouse and you would like to change the legal status between the two of you. That means that you or your spouse do not have to prove anything like adultery to get divorced. There are other reasons that you can either request the court to grant a divorce but this is the most common. To learn more about the options you have in requesting a divorce please see.
Domestic Partnerships. Divorce in a domestic partnership is no different in terms of grounds for seeking a divorce or legal separation. You do however, have to file on a form for a Petition for Domestic Partnership as a Marriage does not currently apply to same sex couples in the State of California. What are the requirements to get a divorce in California?
Residency Requirements: "A judgment of dissolution of marriage may not be entered unless one of the parties to the marriage has been a resident of this state for six months and of the county in which the proceeding is filed for three months next preceding the filing of the Petition."
Property Division: Once the other party, known as the Respondent is served with papers, neither party may transfer, encumber, or otherwise make decisions unilaterally about community property assets unless there is a written agreement. The property will be divided either by court order or written agreement between the parties.
